General terms and conditions

This is a summary, not the terms themselves. Only the Dutch general terms and conditions of Koreman Advocatuur B.V. apply to engagements. They have been filed with the Dutch Chamber of Commerce under number 18078906. This English page is an informative summary and has no contractual effect. What the terms cover

The Dutch general terms and conditions apply to every engagement given to Koreman Advocatuur B.V., including follow up and additional instructions. They deal in outline with the following subjects.

The engagement

Who the contracting party is, how an engagement comes about, and that engagements are accepted exclusively by Koreman Advocatuur B.V. and not by any individual working for it.

Fees and invoicing

How fees are calculated, which disbursements are charged on, the payment term, and what happens if an invoice remains unpaid.

Limitation of liability

Liability is limited to the amount paid out under the firm’s professional indemnity insurance in the relevant case, plus the applicable excess. This is a common arrangement in the Dutch legal profession and is subject to the rules of the Dutch Bar Association.

Engaging third parties

Under what conditions third parties such as bailiffs, experts and foreign lawyers may be engaged, and how liability for their work is arranged.

File retention

How long files are kept after a matter closes, and when they are destroyed.

Complaints and applicable law

The complaints procedure that applies first, and the fact that Dutch law governs the relationship and that a designated Dutch court has jurisdiction.

If you want the terms in English

Ask and I will discuss it with you. For a binding English version a legal translator would need to be engaged, and I would rather be honest about that than hand you a translation that could be read differently from the Dutch text in a dispute.
